SEC seeks public comment on ETF innovation

The U.S. Securities and Exchange Commission is requesting public comment [https://seekingalpha.com/pr/20568878-sec-seeks-public-comment-on-novel-exchange-traded-funds]on exchange-traded funds, or ETFs, seeking to invest in innovative asset classes or that use novel investment strategies, the regulator said Tuesday.

The request focuses on ways to encourage innovation in the ETF space while protecting investments, maintaining fair, orderly, and efficient markets, and facilitating capital formation.

"The commission’s request for comment seeks input from the public on how the U.S. ETF market can continue to grow and innovate while serving investors effectively," SEC Chairman Paul Atkins said.

Brian Daly, director of the SEC's division of investment management, underscored the sector's rapid growth, rising to $12T in assets at the end of 2025 from $4T in 2019. "As ETFs continue to grow and novel strategies emerge, public engagement is essential to answering key questions to make the next years of development a success," Daly said.

The commission requests comment regarding the status of certain novel ETFs as investment companies, the regulation of novel ETFs, and how the registration process for novel ETFs can continue to operate effectively.
